Special Master

A special master in commercial litigation is a neutral, court-appointed expert—often an experienced attorney designated under rules like Federal Rule of Civil Procedure 53 (or similar state provisions) to assist the presiding judge by handling specific aspects of a case. In complex commercial disputes, which frequently involve voluminous discovery, technical accounting/financial issues, intellectual property intricacies, or multi-party coordination, the special master may oversee and resolve discovery disputes (including e-discovery challenges), conduct hearings, take evidence, provide recommended rulings on motions, prepare detailed reports with findings and recommendations, monitor compliance with court orders, or even facilitate settlement discussions. The parties retain the right to object to the special master's recommendations, and the judge retains ultimate authority, reviewing and adopting, modifying, or rejecting the special master's work.

Special masters are particularly helpful in keeping litigation on track because they provide focused expertise and efficiency that busy trial judges often lack time for in high-stakes, document-heavy, or unusually contentious commercial cases. By swiftly adjudicating contentious pre-trial matters like privilege logs, overbroad discovery requests, or sanctions motions—tasks that might otherwise clog the court's docket with repeated hearings and delays—they prevent bottlenecks, reduce motions practice, and accelerate progress toward resolution or trial. Their impartial oversight minimizes gamesmanship, ensures fair and timely compliance, and can significantly cut overall costs and duration for all parties while allowing the judge to concentrate on core legal and dispositive issues.
