Mediation is a voluntary, confidential process in which a neutral third party—the mediator—helps disputing parties communicate effectively, identify their underlying interests, and explore mutually acceptable solutions to resolve their conflict without going to trial. Unlike a judge or arbitrator, the mediator does not decide the case or impose a ruling; instead, the mediator facilitates dialogue, reframes issues, manages emotions, and attempts to guide the parties toward creative, practical agreements that often preserve relationships and save time and money.
An experienced mediator brings significant value by reading the dynamics in the room, asking probing yet non-confrontational questions, and challenging unrealistic positions or unstated assumptions. The mediator's deep understanding of negotiation psychology, subject-matter expertise (in areas like commercial disputes or employment matters), and track record of settling tough cases often help parties break impasses, uncover options neither side had previously considered, and reach durable, voluntary settlements—even in emotionally charged or high-stakes situations.
